Terms of Service
The terms on which Jobivo Digital Services Limited (RC 9697026) provides the platform. There are two sets, and which one binds you depends on how you use it.
Customer Terms of Service
These apply to you if you book a service on Jobivo.

1. Introduction and Acceptance
Welcome to Jobivo Digital Services Limited (RC 9697026) ("Jobivo", "Company", "we", "our", or "us"), an online marketplace platform that enables Customers to discover, book, and pay independent, verified service professionals ("Pros") for artisan, home, and professional services (each, a "Job"). These Customer Terms of Service ("Terms") govern your access to and use of the Jobivo website and mobile application (together, the "Platform") as a customer ("Customer", "you", "your"). By creating a Customer account, making a Booking, or otherwise using the Platform, you confirm that you have read, understood, and agree to be legally bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. These Terms constitute a valid and binding electronic contract between you and Jobivo, enforceable in accordance with the Evidence Act 2011 (as amended) and the Cybercrimes (Prohibition, Prevention, etc.) Act 2015. If you do not agree to these Terms, you must not register for an account or use the Platform. These Terms govern only your relationship with Jobivo as a Customer. They do not govern the relationship between Jobivo and Pros, which is addressed in a separate Pro Terms of Service, and they do not constitute our Privacy Policy, which is a separate document referenced herein.
2. Definitions
• "Booking" means a request by a Customer for a Pro to perform a Job, submitted and confirmed through the Platform.
• “Job” means the service to be provided by a Pro to a Customer pursuant to a Booking.
• "Direct Settlement" means a payment arrangement under which a Customer settles the amount payable for a Job directly with the Pro, outside Jobivo's payment-processing rails, where that option is expressly made available through the Platform.
• "Personal Data", "Data Controller", "Data Processor", and "processing" have the meanings given to them under the Nigeria Data Protection Act 2023 ("NDPA").
• "NDPC" means the Nigeria Data Protection Commission.
• "Chargeback" means a reversal or disputed card transaction initiated through a Customer's card issuer, bank, payment scheme, or other applicable payment institution.
• "Pro" means an independent, third-party service professional who has registered on the Platform to offer services to Customers.
• "Paystack" means Paystack Payments Limited, a third-party payment provider used by Jobivo to process payments.
3. Eligibility and Account Registration
To create a Customer account, you must be at least 18 years of age and have the legal capacity to enter into binding contracts under Nigerian law. By registering, you represent and warrant that all information you provide, including your name, phone number, email address, and payment details, is true, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify Jobivo immediately at support@jobivo.ng if you become aware of any unauthorised access to, or use of, your account. Jobivo shall not be liable for any loss arising from your failure to safeguard your login credentials, save where such loss arises from Jobivo's own negligence or breach of its security obligations. Jobivo reserves the right to decline registration, request additional verification, or suspend or close an account where these eligibility requirements are not met, where information provided is false or misleading, or where necessary to comply with applicable law, including anti-fraud and know-your-customer obligations.
4. Nature of the Platform and Relationship with Pros
Jobivo is a technology marketplace that connects Customers with independent Pros. Jobivo does not employ Pros, and Pros are not agents, partners, franchisees, or employees of Jobivo. Jobivo does not itself perform, supervise, or guarantee the performance of any Job. Where the Platform describes a Pro as "verified", this refers only to Jobivo's completion of identity, contact, and/or documentation checks at onboarding, and does not constitute a guarantee, warranty, or representation as to the quality, safety, timeliness, or legality of any Job performed by that Pro. The contract for the performance of a Job is formed directly between you and the Pro; Jobivo is not a party to that contract and facilitates only the booking, communication, and payment-processing functions described in these Terms.
5. Bookings and Payments
5.1. Making a Booking When you submit a Booking, the applicable fee (comprising the Pro's quoted amount and any Jobivo service fee, each shown separately at checkout) can either be processed through Paystack or Direct Settlement. All amounts are stated and settled in Nigerian Naira (NGN). 5.2 Payment Authorisation You authorise Jobivo and Paystack to process this transaction using the payment details you provide, and you agree to ensure such details are accurate and that sufficient funds or credit are available. 5.3 Price Disclosure Jobivo will disclose the full price of a Booking, including any applicable service fee, before you confirm payment. No additional charges will be applied without your prior consent, save for cancellation fees disclosed in Section 8. 5.4 Booking Information and Personal Data Jobivo collects the information necessary to facilitate bookings and operate the platform. A Customer's street address is retained within Jobivo and is not transmitted from the customer's browser to external geocoding services. Before a Pro accepts a booking, the Pro is shown the relevant area rather than the customer's full street address. The full address may be disclosed where necessary to facilitate an accepted booking, subject to Jobivo's Privacy Policy.
6. Payment Processing
6.1 Payment for a Booking may be made either directly between the Customer and the Pro, where the Pro has made Direct Settlement available, or through Jobivo's third-party payment provider where card payment through the Platform is available. Where payment is made through Jobivo, the applicable amount will be processed through Jobivo's payment provider. 6.2 Jobivo does not itself receive, hold, custody or manage Customer funds. Jobivo does not operate an escrow service. Where a Customer settles directly with a Pro, Jobivo does not process, hold or control that payment and cannot reverse, refund or recover the payment on the Customer's behalf. Any dispute arising from a Direct Settlement may be addressed through Jobivo's dispute process where applicable, but Jobivo does not guarantee recovery of amounts paid directly to a Pro. 6.3 Once payment has been processed, Jobivo cannot automatically reverse or recover funds that have been paid to a Pro. Where a Customer raises a dispute in accordance with Section 8, Jobivo may facilitate communication between the parties, seek recovery from the Pro where appropriate, and take action against the Pro's account or standing in accordance with these Terms. 6.4 Jobivo does not charge a separate fee for payment processing or dispute resolution unless expressly stated otherwise before payment.
7. Chargebacks
7.1 A Customer may have rights to dispute or reverse a card transaction through their bank or payment card provider in accordance with the applicable card scheme rules and payment provider procedures. 7.2 Where a Customer initiates a chargeback in respect of a Booking, the Customer agrees to provide Jobivo with any information or evidence reasonably required to investigate and respond to the chargeback. 7.3 A chargeback does not automatically determine whether a Customer is entitled to a refund from a Pro or Jobivo. Jobivo may review the Booking, the communications between the parties, evidence of completion, payment records, and any other relevant information in responding to the chargeback. 7.4 Where a chargeback is determined to have resulted from fraud, unauthorised use of the Customer's payment method, or an improper reversal of a legitimate transaction, Jobivo may take appropriate action against the Customer's account, including suspension or termination, without prejudice to any other rights or remedies available to Jobivo. 7.5 Jobivo does not control the outcome of a chargeback and cannot guarantee that a chargeback will be accepted, rejected, reversed, or resolved within any particular period. Chargebacks are subject to the rules and procedures of the applicable payment provider and card scheme. 7.6 Nothing in this Section affects a Customer's right to raise a genuine payment dispute or chargeback through their bank, card issuer, or applicable payment provider in accordance with the applicable rules. 7.7 Where a Booking is settled directly between the Customer and the Pro, any dispute concerning that payment shall be dealt with between the Customer and the Pro and shall not constitute a chargeback against Jobivo. Jobivo may nevertheless facilitate communication or administer the Booking in accordance with the dispute procedures under these Terms.
8. Cancellations, Refunds, and No-Shows
8.1 Customer Cancellation A Customer may cancel a Booking in accordance with the cancellation options made available on the Platform. Where payment has already been made to a Pro, cancellation does not automatically entitle the Customer to a refund from Jobivo, as Jobivo does not hold the Pro's funds. 8.2 Pro Cancellation A Pro may cancel an accepted Booking before the Job is marked complete. The Pro must provide a reason for the cancellation, and Jobivo will notify the Customer. Where a Pro cancels after payment has been made, Jobivo may facilitate communication between the Customer and the Pro and use reasonable efforts to assist the Customer in recovering the amount paid. Jobivo may also take appropriate action against the Pro's account or standing on the Platform. 8.3 Pro No-Show or Non-Performance Where a Pro fails to attend a confirmed Booking or materially fails to perform the agreed Job, the Customer may raise a dispute in accordance with Section 9. 8.4 Refunds Because Jobivo does not hold or custody funds paid to a Pro, Jobivo cannot guarantee or independently execute a refund of amounts already paid to the Pro. Where appropriate, Jobivo may facilitate recovery from the Pro and take appropriate platform action. 8.5 Records and Platform Action Jobivo records cancellations and disputes, including who acted, when the action occurred and the reason provided. Jobivo may use these records when assessing the conduct and standing of users on the platform. A dispute or cancellation may affect a user's standing, visibility, access to platform features or continued participation on Jobivo where Jobivo considers such action appropriate under these Terms.
9. Disputes Between Customers and Pros
If a Customer and Pro cannot agree on the outcome of a job, the Customer may raise a dispute on the booking page within 72 hours of the job being marked complete. The Pro will be notified and invited to respond, and the response will form part of the dispute record. Jobivo's Trust and Safety team will review the evidence submitted by both parties, which may include completion notes, photographs and communications, and will aim to issue a platform decision within three (3) business days. A dispute decision records Jobivo's findings for the purpose of administering the platform. It does not, by itself, create an obligation on Jobivo to refund, reverse or recover funds that have already been paid to a Pro, as Jobivo does not hold the Pro 's share of Customer payments. Where payment for the booking has not yet been made through Jobivo, an open dispute will prevent further card payment for that booking through Jobivo until the dispute is resolved. This does not prevent the parties from reaching their own arrangement directly. Where payment has already been made to the Pro, Jobivo cannot freeze or recover those funds through the platform. Where appropriate, Jobivo may contact the Pro, facilitate communication between the parties, require the Pro to address the matter, or take action against a party's standing on the platform, including suspension or removal. Only the Customer may initiate a dispute under this section. The Pro may respond to a dispute opened against them but may not initiate a dispute through the platform. A Customer may not raise more than one dispute in respect of the same booking.
10. Customer Obligations
• Provide accurate Job descriptions, location details, and any information reasonably required for the Pro to perform the Job.
• Be reasonably available at the agreed time and location, or provide adequate notice of any change.
• Treat all Pros and Jobivo staff with courtesy and respect; harassment, threats, or abuse will not be tolerated and may result in account suspension.
• Not request that a Pro perform services materially outside the scope agreed at Booking without a corresponding update to the Booking.
• Pay all amounts due in accordance with the payment method selected for the Booking. Where Direct Settlement has been made available by the Pro, the Customer may settle the Booking directly with the Pro by the payment method agreed between them. Customers and Pros must not use direct payment or any other off-platform arrangement for the purpose of circumventing Jobivo's applicable fees, payment processes, or other platform requirements. Jobivo shall not be responsible for payments made outside the Platform
11. Prohibited Conduct
You must not:
• Post false, misleading, or fraudulent Bookings or information.
• Make payment outside the payment method selected for a Booking for the purpose of circumventing Jobivo's applicable fees, payment processes, platform rules or protections, except where Direct Settlement is expressly permitted through the Platform
• Use the Platform for any unlawful purpose, or in a manner that infringes the rights of Jobivo, any Pro, or any third party.
• Harass, threaten, defame, or abuse any Pro or member of Jobivo staff.
• Create or use multiple accounts to exploit promotions, referral schemes, or the ratings system.
• Reverse-engineer, scrape, disrupt, or attempt to gain unauthorised access to the Platform or its underlying systems. A breach of this Section may result in suspension or termination of your account under Section 17 and, where appropriate, referral to law enforcement or civil action.
12. Reviews and Ratings
Following a Booking that was paid through the Platform, you may submit a rating and review of the Pro. Reviews are limited to Bookings for which Jobivo processed the payment. Where a Job is settled directly with a Pro, Jobivo holds no record that the Job was paid for and a review cannot be submitted for it. This applies equally to a Pro rating a Customer. Reviews must reflect your genuine, good-faith experience and must not be false, defamatory, or submitted for any purpose other than sharing that experience. Jobivo reserves the right, but not the obligation, to remove or moderate reviews that violate this Section or applicable law. Reviews may be displayed publicly on the relevant Pro's profile.
13. Intellectual Property
The Platform, including its software, design, trademarks, logos, and content (excluding Customer-submitted content and Pro profiles), is owned by or licensed to Jobivo and is protected under Nigerian and applicable international intellectual property law. Jobivo grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal, non-commercial use in accordance with these Terms. You must not copy, modify, distribute, or create derivative works from the Platform except as expressly permitted.
14. Disclaimers and Limitation of Liability
14.1 The Platform is provided on an "as is" and "as available" basis. Jobivo does not warrant that the Platform will be uninterrupted, error-free or completely secure, but will take reasonable measures to maintain the availability and security of the Platform. 14.2 Jobivo operates a marketplace that connects Customers with independent Pros. Jobivo does not employ Pros and does not itself perform the Jobs offered through the Platform. Accordingly, Jobivo does not guarantee the quality, safety, legality, suitability, timeliness or outcome of any Job performed by a Pro. 14.3 Any verification carried out by Jobivo is limited to the checks expressly stated on the Platform and does not constitute a guarantee of a Pro's qualifications, conduct, skill, performance or suitability for a particular Job. 14.4 Subject to applicable law, Jobivo shall not be liable for indirect, incidental, special or consequential loss arising from a Customer's use of the Platform or a Job performed by a Pro. 14.5 Subject to the exclusions in this Section and to any liability which cannot lawfully be excluded or limited, Jobivo's total aggregate liability to a Customer arising directly from Jobivo's breach of these Terms shall not exceed ₦50,000. 14.6 Nothing in these Terms excludes or limits liability for death or personal injury caused by Jobivo's negligence, fraud or fraudulent misrepresentation, wilful misconduct, breach of applicable data protection obligations, or any other liability which cannot lawfully be excluded or limited under Nigerian law.
15. Indemnification
You agree to indemnify and hold Jobivo, its officers, employees, and agents harmless from and against any claims, losses, liabilities, and reasonable expenses (including legal fees) arising out of your breach of these Terms, your violation of applicable law, or your misuse of the Platform, save to the extent such claims arise from Jobivo's own negligence, wilful misconduct, or breach of these Terms.
16. Data Protection and Privacy
Jobivo acts as a Data Controller in respect of the personal data it collects from you to operate the Platform, including your name, contact details, location, payment information, and booking history. This data is collected and processed in accordance with the Nigeria Data Protection Act 2023, applicable NDPC guidelines and regulations, and our Privacy Policy, which is incorporated into these Terms by reference and sets out full details of our processing activities. Jobivo processes your personal data on the basis of: performance of the contract between you and Jobivo (to operate your account and facilitate Bookings); your consent, where separately obtained (for example, for marketing communications); compliance with a legal obligation; and Jobivo's legitimate interests in operating, securing, and improving the Platform, provided such interests do not override your fundamental rights and freedoms. You have rights under the NDPA and the GAID, including to access, correct, or request deletion of your personal data, to object to processing based on legitimate interest, to serve a Standard Notice to Address Grievance on us directly, and to lodge a complaint with the Nigeria Data Protection Commission at ndpc.gov.ng. To exercise these rights, contact our Data Protection Officer at privacy@jobivo.ng. Jobivo will retain your personal data only for as long as necessary to fulfil the purposes described in our Privacy Policy or to comply with applicable legal, regulatory, or accounting obligations, after which it will be securely deleted or anonymised. Where Jobivo transfers your personal data outside Nigeria, including to payment processing or cloud infrastructure providers, it will do so only where the recipient country has been assessed as providing adequate data protection, or where appropriate safeguards (such as standard contractual clauses or other mechanisms recognised under the NDPA and applicable NDPC guidelines) have been put in place. Jobivo maintains reasonable technical and organisational measures to protect your personal data. In the event of a personal data breach likely to result in a risk to your rights and freedoms, Jobivo will notify the NDPC and, where required, affected Customers, in accordance with the timelines and thresholds prescribed under the NDPA and applicable NDPC guidelines. Jobivo does not sell your personal data to third parties. Questions or requests relating to your personal data may be directed to our Data Protection Officer at privacy@jobivo.ng
17. Account Suspension and Termination
Jobivo may suspend or terminate your account, with or without notice, where you breach these Terms, engage in fraudulent or unlawful conduct, or where suspension is necessary to protect the safety of Pros, other Customers, or the Platform. Except in cases of suspected fraud or serious misconduct, Jobivo will provide notice and a reasonable opportunity to remedy minor breaches before suspension. A Customer may appeal a suspension by contacting Jobivo at support@jobivo.ng within fourteen (14) days of the suspension. Jobivo will review the appeal and may request any information reasonably necessary to assess the circumstances giving rise to the suspension. You may close your account at any time by contacting support@jobivo.ng. Termination of your account does not affect any rights or obligations that accrued before termination, including outstanding payment obligations or unresolved disputes, which shall survive termination.
18. Force Majeure
Jobivo shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including natural disasters, strikes, civil unrest, government action, power or telecommunications failures, or failures of third-party payment or infrastructure providers.
19. Complaints and Regulatory Escalation
If you have a complaint about the Platform that is not resolved to your satisfaction through Jobivo's internal complaints process (support@jobivo.ng), you may escalate it to the Federal Competition and Consumer Protection Commission (FCCPC) in respect of consumer protection matters, or to the Nigeria Data Protection Commission (NDPC) in respect of data protection matters, without prejudice to your right to pursue any other remedy available to you under applicable law.
20. Dispute Resolution and Governing Law
These Terms are governed by, and shall be construed in accordance with, the laws of the Federal Republic of Nigeria. The parties shall first attempt in good faith to resolve any dispute arising out of or in connection with these Terms through Jobivo's internal complaints process. Where a dispute is not resolved within 30 days of being raised, either party may refer it to arbitration in Lagos, Nigeria, before a sole arbitrator appointed in accordance with, and finally resolved under, the Arbitration and Mediation Act 2023. The arbitration shall be conducted in English, and the arbitral award shall be final and binding on the parties, subject to any right of challenge available under that Act. Nothing in this Section prevents either party from seeking urgent injunctive or other interim relief from a court of competent jurisdiction, and the courts of Lagos State shall have non-exclusive jurisdiction for that purpose and for the enforcement of any arbitral award.
21. General Provisions
21.1 Amendments Jobivo may update these Terms from time to time. Where changes are material, we will notify you by email or in-app notification at least 14 days before the changes take effect. Your continued use of the Platform after that date constitutes acceptance of the updated Terms; if you do not agree, you should stop using the Platform before the changes take effect. 21.2 Assignment Jobivo may assign or transfer its rights and obligations under these Terms, including in connection with a merger, acquisition, or sale of assets, provided this does not materially diminish your rights under these Terms. You may not assign your rights or obligations under these Terms without Jobivo's prior written consent. 21.3 Severability If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be so modified, and the remaining provisions shall continue in full force and effect. 21.4 Entire Agreement These Terms, together with the Privacy Policy, constitute the entire agreement between you and Jobivo in respect of your use of the Platform as a Customer, and supersede any prior agreements or understandings on that subject. 21.5 Waiver No failure or delay by Jobivo in exercising any right under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise preclude any further exercise of that or any other right. 21.6 No Third-Party Rights These Terms do not confer any rights on any person other than you and Jobivo, and no third party shall have any right to enforce any provision of these Terms. 21.7 Notices Notices to you will be sent to the email address or in-app contact details associated with your account. Notices to Jobivo should be sent to support@jobivo.ng. 21.8 Language These Terms are drafted in English. Where these Terms are translated into any other language, the English version shall prevail in the event of any inconsistency.
Provider Terms of Service
These apply to you if you offer services on Jobivo, as an individual or a company.

These Professional Terms of Service ("Terms") govern your registration and use of the Jobivo platform (the "Platform") as a Pro, whether you register as an individual or a registered company. By creating a Pro account, you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated by reference. These Terms constitute a valid and binding electronic contract, enforceable in accordance with the Evidence Act 2011 (as amended) and the Cybercrimes (Prohibition, Prevention, etc.) Act 2015. These Terms govern only your relationship with Jobivo as a Pro; they do not govern the separate relationship between Jobivo and Customers, and they do not constitute our Privacy Policy.
2. Definitions
• "Booking" means a request accepted by a Pro to perform a Job for a Customer through the Platform.
• “Job” means the service to be provided by a Pro to a Customer pursuant to a Booking.
• "Direct Settlement" means a payment arrangement under which a Customer settles the amount payable for a Job directly with the Pro, outside Jobivo's payment-processing rails, where that option is expressly made available through the Platform.
• "Chargeback" means a reversal or disputed card transaction initiated through a Customer's card issuer, bank, payment scheme, or other applicable payment institution.
• "Sensitive Personal Data" includes biometric data (such as a selfie used for identity verification) and other categories the NDPA identifies as attracting heightened protection.
• "NDPC" means the Nigeria Data Protection Commission.
3. Eligibility
To register as a Pro, you must: be at least 18 years old; be legally permitted to provide the services you offer in Nigeria, and remain so permitted throughout your use of the Platform; provide accurate personal or business information during registration; and complete identity verification (KYC) as required by the Platform. Company Pros must be duly registered with the Corporate Affairs Commission (CAC). By registering, you warrant that all information you submit is accurate and up to date, and that you hold, and will maintain, any licence, permit, or certification required by Nigerian law for the services you offer.
4. Identity Verification (KYC)
Jobivo requires all Pros to complete identity verification (KYC) before their profile can be listed or receive Bookings. This includes: for individual Pros, your National Identification Number (NIN) or Bank Verification Number (BVN); for company Pros, your CAC registration number, CAC Certificate of Incorporation, CAC Status Report, and the Director/Owner's NIN; and a selfie for face verification, which is required both of individual Pros and of the Director or Owner named on a company account. An account cannot be approved until that face verification is complete. Your NIN, BVN, and selfie constitute personal data subject to heightened protection under the Nigeria Data Protection Act 2023 ("NDPA"). Jobivo processes this data in accordance with the lawful bases and purposes described in its Privacy Policy and applicable data protection law. Full details are set out in the Privacy Policy. Failure to complete or satisfactorily pass the applicable KYC process will prevent your profile from being listed or receiving Bookings. Jobivo reserves the right to suspend or terminate an account where KYC cannot be completed or verified.
5. Your Role as a Service Provider
You are an independent service provider. Nothing in these Terms creates an employment, agency, partnership, joint venture, or fiduciary relationship between you and Jobivo. In particular: you are free to accept or decline any Booking; you determine your own working hours and schedule; you may provide services through other platforms or independently, without exclusivity to Jobivo; you use your own tools, equipment, and materials; and you are not entitled to any employee benefit from Jobivo. You are solely responsible for: the quality, safety, and legality of the services you provide, which you agree to perform with reasonable skill, care, and diligence and to a standard consistent with your stated trade or profession; obtaining any licences, permits, or certifications required by law; all applicable taxes, levies, statutory deductions, and other fiscal obligations arising from your earnings, including (without limitation) Personal Income Tax, Companies Income Tax, and Value Added Tax; and any damage, injury, or loss caused to Customers or their property during service delivery. Jobivo makes no guarantee as to the volume of Bookings you will receive.
6. Service Standards and Obligations
By accepting a Booking, you agree to: arrive on time at the Customer's stated location; complete the service to a professional standard consistent with Section 5 above, as described in your profile and agreed with the Customer; communicate promptly and professionally with Customers through the Platform; not request, solicit or encourage a Customer to make payment outside the payment method selected for a Booking for the purpose of circumventing Jobivo's applicable fees, payment processes, platform rules or protections. Where Direct Settlement is expressly made available through the Platform, you may accept payment directly from the Customer in accordance with the terms presented for that Booking and must accurately record the settlement where required by the Platform; Persistent poor ratings, Customer complaints, or failure to meet these standards may result in account suspension or removal from the Platform.
7. Payment and Payout Terms
Payment for a Booking may be made either through Jobivo's designated payment processing partner or, where expressly made available through the Platform, by Direct Settlement between the Customer and the Pro. Where payment is made through Jobivo's payment processing partner, Jobivo does not itself receive, hold, custody or manage Customer funds and does not operate an escrow service. Funds are processed and settled through the applicable payment provider in accordance with its payment and settlement arrangements. Where Direct Settlement is selected or otherwise permitted, the Customer settles the agreed amount directly with the Pro. Jobivo does not receive, hold or forward such payment. Jobivo does not deduct a transaction fee from the Pro's agreed service amount. Jobivo's fees, where applicable, are charged separately in accordance with these Terms and the applicable subscription or platform arrangements. You are responsible for ensuring that any bank or payment details provided to Jobivo are accurate and current. Jobivo is not liable for failed or delayed settlement resulting from incorrect information supplied by you or from delays or failures attributable to a third-party payment provider.
8. Platform Fee
Jobivo does not deduct a transaction fee from the Pro's agreed service amount. Jobivo earns revenue through subscription plans (Starter, Premium and Business) and optional featured-listing upgrades. Your subscription tier determines your Booking allowances, profile visibility, and access to premium features.
9. Subscription Plans and Non-Payment
Premium and Business plans are charged monthly in advance using the payment method provided by you. You may cancel your subscription at any time through the applicable billing controls. Cancellation prevents the next renewal charge and does not affect your access to the paid plan for the period already paid for. If a renewal payment fails, your subscription will not be cancelled immediately. Jobivo may notify you by email, WhatsApp or other registered communication channels and may retry the payment using the payment method provided. Paid features will remain available for fourteen (14) days from the first failed renewal attempt. If payment has not been successfully completed after that period, Jobivo may pause the paid features associated with your subscription. During a suspension of paid features, your account, profile, reviews, job history and Bookings already accepted by you will remain available, but features available only under the applicable paid plan may be disabled or restricted. The subscription will remain open while the paid features are paused. If a valid payment method is subsequently charged successfully, the applicable paid features will be restored without requiring you to create a new subscription. If payment is not successfully completed and the subscription subsequently ends, your account will revert to the free Starter plan. No late fee will be charged, and Jobivo will not pursue subscription charges attributable solely to a period during which your paid features were paused. The fourteen (14) day period referred to in this Section may be updated where the applicable platform configuration is changed, subject to the amendment provisions in these Terms.
10. Cancellations and No-Shows
If you accept a Booking and then cancel: (a) more than 24 hours before the scheduled date, your cancellation will be recorded against your account and may affect your cancellation history; (b) less than 24 hours before the scheduled date, the cancellation will be treated as a late cancellation and may negatively affect your profile ranking and visibility; and (c) a no-show, being a failure to attend the agreed Job without reasonable notice or cancellation, is recorded against the Booking and may result in action against your account, up to and including suspension. Repeated cancellations or no-shows put your standing on the Platform at risk. Where a Customer has already paid you directly or payment has otherwise been settled to you, Jobivo does not hold the funds and cannot automatically reverse or refund that payment. Where a refund is appropriate, you remain responsible for returning amounts you have received from the Customer. Jobivo may facilitate communication between the parties, require you to address the matter, and take appropriate action against your account or standing on the Platform. Where a Booking was paid through Jobivo's designated payment processing partner, Jobivo may facilitate the applicable refund or recovery process in accordance with Section 12 and the applicable Customer Terms, but does not guarantee recovery of amounts already settled to you.
11. Chargebacks
A Customer who pays by card may dispute or seek reversal of a payment through the Customer's bank, card issuer, or applicable payment scheme. Where a chargeback relating to a booking results in Jobivo being required to refund, reverse, or otherwise reimburse an amount previously settled to a Pro, the Pro shall reimburse Jobivo for the amount recovered or charged against Jobivo in respect of that transaction, together with any applicable chargeback, scheme, processing, or administrative fee properly imposed on Jobivo by its payment provider or card scheme. Jobivo may notify the Pro of the chargeback and request information or evidence reasonably required to respond to or defend the chargeback. The Pro agrees to provide such information within the timeframe reasonably specified by Jobivo. Where Jobivo is required to recover an amount from the Pro under this Section, the amount shall become immediately due and payable upon written demand. Subject to applicable law, Jobivo may suspend the Pro's account, restrict access to paid features, remove or limit the Pro's listing, or decline further Bookings until the amount is resolved. Jobivo may submit Booking records, communications, completion records, photographs, Customer or Pro statements, and other relevant evidence to its payment provider or card scheme in connection with a chargeback. A chargeback does not, by itself, constitute a finding that the Pro acted improperly. Jobivo may consider the evidence available when determining what platform action, if any, is appropriate.
12. Customer Disputes
A Customer may raise a dispute concerning a Booking through the Platform in accordance with the applicable Customer Terms. Where a dispute is raised against you, Jobivo will notify you and provide you with an opportunity to respond. You agree to provide any information, explanation, photographs, completion records, communications, or other evidence reasonably requested by Jobivo in connection with the dispute. Jobivo may review the information available to it and make a platform determination for the purpose of administering the Booking and taking appropriate action under these Terms. Such determination does not constitute a final determination of the parties' underlying legal rights and does not prevent either party from pursuing any remedy available under Nigerian law. Jobivo may take appropriate action against a Pro's account following a dispute, including issuing a warning, recording the dispute against the account, restricting the account, suspending the account, or terminating the account where warranted. Where payment has already been made directly to the Pro, Jobivo does not hold the funds and cannot independently reverse or refund the payment. Where appropriate, Jobivo may facilitate communication between the parties and request that the Pro return any amount properly due to the Customer.
13. Business Professionals
Your account represents the business, not an individual employee. You must provide your CAC registration number, tell us which register it is on, and give a valid office address.
CAC keeps separate registers and the numbering is independent, so we search the one you name. A limited company (RC) is a separate legal person and has directors. A business name (BN) is not a separate legal person — it has a proprietor, and that proprietor is personally responsible for the work and its liabilities. Incorporated trustees (IT) have trustees. Pick what your certificate actually says rather than the title you use day to day: many owners describe themselves as a director when their certificate says business name, and naming the wrong register means the check cannot find you.
Your payout account must be in the registered business name, or, if you are registered as a business name, in the proprietor’s own name — a sole trader who banks under their own name is not excluded. Any Customer payments made directly to the Company shall be settled to the Company's designated payment account, and any payment processed through a third-party payment provider shall be subject to that provider's applicable settlement arrangements. You are responsible for all staff members who deliver services under your company account, including full compliance with Nigerian labour, tax, and other applicable law in respect of your own employment relationship with such staff, which is a matter entirely between you and your staff and does not involve Jobivo. Individual staff members must not create separate Pro accounts for work done under your company.
14. Prohibited Conduct
You must not: provide false information in your profile or during KYC; request, solicit or accept payment outside the payment method selected for a Booking for the purpose of circumventing Jobivo's applicable fees, payment processes, platform rules or protections, except where Direct Settlement is expressly permitted through the Platform; create fake reviews for yourself or other Pros; harass, threaten, or abuse Customers or Jobivo staff, including conduct prohibited under the Cybercrimes (Prohibition, Prevention, etc.) Act 2015; offer illegal, unsafe, or unlicensed services; engage in or facilitate fraud or money laundering; infringe Jobivo's or any third party's intellectual property; share your account access with, or allow impersonation by, any other person; create multiple accounts to circumvent suspensions or restrictions; or use Customer contact details obtained through Jobivo for marketing or solicitation outside the Platform. Violation may result in immediate suspension, permanent removal, and/or legal action.
15. Account Suspension and Termination
Jobivo may suspend or terminate your account where: (a) you breach these Terms; (b) your KYC information cannot be verified or you fail to complete required verification; (c) you accumulate excessive cancellations, complaints or other adverse conduct records; (d) we receive credible evidence of fraud, abuse, unlawful activity or conduct that poses a material risk to Customers, other Pros or the Platform; (e) you fail to pay subscription fees or other amounts properly due to Jobivo under these Terms; or (f) suspension or termination is reasonably necessary to protect the safety, security or integrity of the Platform. Except where immediate action is reasonably necessary because of fraud, serious misconduct, safety concerns, legal requirements or other material risk, Jobivo may provide reasonable notice and an opportunity to remedy the relevant breach. Because Jobivo does not hold or custody Provider funds, termination does not create any obligation on Jobivo to release or process a "pending payout". Any payment already made directly to you remains subject to your obligations to the Customer, including any applicable refund or chargeback obligation. You may appeal a suspension by contacting support@jobivo.ng within fourteen (14) days. The provisions of Sections 5 (Your Role as a Service Provider), 7 (Payment and Payout Terms), 11 (Chargebacks), 12 (Customer Disputes), 16 (Intellectual Property), 17 (Limitation of Liability), 18 (Indemnity), 19 (Privacy and Data), 20 (Force Majeure), 21 (Electronic Communications), 23 (Dispute Resolution and Governing Law), and 24 (General Provisions) shall survive termination of these Terms to the extent necessary to give effect to their respective provisions.
16. Intellectual Property
The Platform, including its software, design, trademarks, and content (excluding your own profile content), is owned by or licensed to Jobivo and protected under Nigerian and applicable international intellectual property law. You retain ownership of the content you upload to your profile (such as your bio and portfolio images), and you grant Jobivo a nonexclusive, royalty-free licence to display that content on the Platform for the purpose of operating your profile.
17. Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. Jobivo does not warrant that the Platform will be uninterrupted, error-free, or secure, though it will take reasonable steps to maintain availability and security. Jobivo does not guarantee the number of Bookings you will receive. To the fullest extent permitted under Nigerian law, Jobivo's total aggregate liability to you arising out of or in connection with these Terms, whether in contract, tort, or otherwise, shall not exceed the greater of (a) the subscription fees you paid to Jobivo in the twelve (12) months preceding the event giving rise to the claim, or (b) ₦50,000. Nothing in these Terms excludes or limits Jobivo's liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or limited under the laws of the Federal Republic of Nigeria.
18. Indemnity
You agree to indemnify and hold Jobivo, its officers, employees, and agents harmless from and against any claims, losses, liabilities, chargeback amounts, applicable payment or scheme fees, and reasonable expenses (including legal fees) arising out of or in connection with your breach of these Terms, your provision of services to any Customer, your violation of applicable law, or any chargeback attributable to a Booking or transaction for which you received payment, save to the extent such claims arise from Jobivo's own negligence, wilful misconduct, or breach of these Terms.
19. Privacy and Data
Your personal and business data is collected and processed in accordance with our Privacy Policy, the Nigeria Data Protection Act 2023 ("NDPA") and applicable data protection requirements. KYC documents, bank details and activity data are processed for the purposes and on the lawful bases described in our Privacy Policy. Your name, category, rating, reviews and portfolio may be displayed publicly on your profile in accordance with the Privacy Policy. You have rights under the NDPA and the GAID, including to access, correct, or request deletion of your personal data, to object to processing based on legitimate interest, to serve a Standard Notice to Address Grievance on us directly, and to lodge a complaint with the Nigeria Data Protection Commission at ndpc.gov.ng. 20. Force Majeure
Jobivo shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including natural disasters, strikes, civil unrest, government action, power or telecommunications failures, or failures of third-party payment or infrastructure providers.
21. Electronic Communications
You consent to receiving notices, disclosures, and other communications from Jobivo electronically, including by email, SMS, WhatsApp, or in-app notification. Electronic records of Bookings, communications, and confirmations made through the Platform shall be admissible as evidence of their terms to the same extent as a written and signed document.
22. Changes to Terms
Jobivo may update these Terms at any time. We will notify you by email or in-app notification at least 14 days before material changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you disagree with the changes, you may close your account before the effective date.
23. Dispute Resolution and Governing Law
These Terms are governed by, and shall be construed in accordance with, the laws of the Federal Republic of Nigeria. The parties shall first attempt in good faith to resolve any dispute through Jobivo's internal complaints process. Where a dispute is not resolved within 30 days of being raised, either party may refer it to arbitration in Lagos, Nigeria, before a sole arbitrator appointed in accordance with, and finally resolved under, the Arbitration and Mediation Act 2023, conducted in English. Nothing in this Section prevents either party from seeking urgent injunctive or other interim relief from a court of competent jurisdiction, and the courts of Lagos State shall have non-exclusive jurisdiction for that purpose and for the enforcement of any arbitral award.
24. General Provisions
Assignment: Jobivo may assign or transfer its rights and obligations under these Terms, including in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations under these Terms without Jobivo's prior written consent. Severability: if any provision of these Terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be so modified, and the remaining provisions shall continue in full force and effect. Entire Agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and Jobivo in respect of your use of the Platform as a Pro. No Waiver: no failure or delay by Jobivo in exercising any right under these Terms shall operate as a waiver of that right. Survival: the provisions identified in Section 15 as surviving termination shall continue in effect notwithstanding termination of your account.
